Terms of Service

1. General Provisions

These Terms of Service (“Terms”) govern the use of the NIMFA online store (“Store”) and apply to all purchases made through www.nimfa.nl.
By accessing or using the Store, the customer (“Customer”) agrees to be bound by these Terms.

If you do not agree to these Terms, you must not use the Store.

NIMFA operates in accordance with Dutch and EU e-commerce regulations.


3. Products
 • Products offered in the Store are intended exclusively for personal use by adults.
 • By placing an order, the Customer confirms that they are 18 years of age or older.
 • Product images and descriptions are provided for reference. Minor variations in colour or appearance may occur.


4. Prices and Payment
 • All prices are listed in euros (€) and include VAT where applicable, in accordance with EU VAT regulations and the OSS (One-Stop Shop) scheme.
 • The applicable VAT rate is automatically calculated at checkout based on the customer’s shipping country.
 • Payments are processed securely via approved payment providers (Shopify Payments, iDEAL, credit card providers).
 • The Store does not store or have access to full payment details.
 • The Customer is responsible for ensuring accuracy of billing information.


5. Order Processing and Acceptance
 • An order is accepted once payment is completed and the Customer receives an order confirmation.
 • The Store reserves the right to refuse or cancel orders in cases of suspected fraud, incomplete information, or violation of these Terms.
 • If an order is cancelled, the Customer will be refunded in full.


6. Delivery
 • Orders are shipped from the Netherlands using reputable courier partners.
 • Delivery times shown at checkout are estimates and may vary.
 • The Store is not liable for delays caused by carriers, incorrect addresses, customs, or circumstances outside our control.
 • Risk of loss transfers to the Customer once the package is handed over to the carrier.


7. Returns and Refunds

Due to the intimate and hygienic nature of most products sold by NIMFA, the standard EU 14-day right of withdrawal does not apply once the hygiene seal is broken or the packaging is opened.

Returns are accepted only in cases of:
 • manufacturing defect;
 • damage during transport (must be supported with immediate photographic evidence);
 • incorrect item delivered.

All conditions for returns are outlined in the Return & Refund Policy, which forms part of these Terms.


8. Customer Responsibilities

The Customer agrees to:
 • provide accurate shipping and billing information;
 • ensure receipt of parcels at the provided address;
 • comply with local laws related to the purchase of intimate products;
 • use products responsibly and according to instructions.

The Store is not liable for misuse of products.


9. Privacy and Data Protection

Personal data is processed in accordance with the GDPR.
Details on data processing, storage, rights, and third-party processors are provided in the Privacy Policy.


10. Intellectual Property

All content on the Store—including text, images, graphics, branding, and design—is the intellectual property of NIMFA and may not be copied, reproduced, or redistributed without our explicit written consent.


11. Limitation of Liability

To the fullest extent permitted by law:
 • The Store is not liable for indirect, incidental, or consequential damages.
 • The Store is not liable for delays, loss, or damage caused by third-party carriers.
 • The total liability of the Store shall not exceed the amount paid for the order in question.

Nothing in this section limits statutory consumer rights.


12. Force Majeure

The Store is not responsible for delays or failures caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, carrier disruptions, technical failures, or government regulations.


13. Changes to the Terms

The Store may update these Terms at any time.
Changes become effective immediately upon publication on the website.
Continued use of the Store constitutes acceptance of the updated Terms.


14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands.
In the event of a dispute, the Customer should first contact support@nimfa.nl to seek an amicable solution.
Unresolved disputes will be handled by the competent Dutch courts.
